California Laws and Lawmaking

The California Department of Corrections has enacted emergency regulations to ban all weightlifting programs and equipment. Public comment period on the new regulations ends 23 February 1998. A hearing will also be held on that date.

The regulations are changed to read, "Inmate weight lifting programs and equipment shall not be permitted at departmental institutions/facilities. Exceptions shall be permitted as specifically authorized by the director in compliance with Penal Code section 5010." Cal. Code Regs., title 15, 3320(g).

We encourage our readers to write to the address above and to tell the California Department of Corrections your feelings on this issue. We also encourage you to reference this web site, www.strengthtech.com in your letter and to tell them about or include a copy of the listing of issues.

On Feb. 13, 1998, we visited with the "Officer of the Day" at California DOC. He told us the weights were banned on Feb. 2nd and the ban was not in response to a specific incident.

Special thanks to the Prison Law Office in San Quentin for calling some of these laws (including the emergency regulations above) to our attention and "starting the hunt". A link is provided to their "Prison Law Page" in the Legislature segment of our Links Section.

Note- The passage of SBX1 22 in 1994 brought about the changes in Section 5010 of the California Penal Code. Among these changes were the requirement that the California Department of Corrections and the California Youth Authority develop regulations governing weight lifting in their institutions by July 1, 1995 considering several specific factors. The resulting regulations are at the California Deptartment of Corrections Regulations link below.
